Birketts’ residential enfranchisement team comprises specialists across all areas of statutory and voluntary lease extensions and enfranchisements.  The six-strong dedicated team is made up of experts in:-

·         Leasehold extensions under the Leasehold Reform, Housing and Urban Development Act 1993;

·         Freehold enfranchisement under the Leasehold Reform, Housing and Urban Development Act 1993;

·         Freehold enfranchisement under the Leasehold Reform Act 1967;

·         The right of first refusal under the Landlord & Tenant Act 1987;

·         The right to manage under the Common-hold & Leasehold Reform Act 2002.

The team routinely acts for landlords, tenants and lenders across a range of property transactions in locations across East Anglia, Essex and London.  It is part of, and supported by, the wider Birketts property team which is one of the largest and best regarded property departments in the East of England with well in excess of 100 specialists. 

The depth and range of the team's expertise enables us to provide our clients with fast and cost-effective solutions on all manner of property issues ranging from the straightforward to the most complex.

Douglas leads the growing practice in residential enfranchisement at Birketts.  He has particular knowledge of the Leasehold Reform, Housing and Urban Development Act 1993 and issues relating to collective enfranchisement and lease term extensions, along with rights of first refusal within the Landlord & Tenant Act 1987.  He acts for both landlords and tenants in these cases.

Nicola has been involved in enfranchisement matters since 2003 and has acted for Colleges, individual landlords and tenants in statutory and voluntary lease extensions, collective enfranchisement matters, disposals under the right of first refusal and the freehold enfranchisement of houses.

Charlotte trained and practised for five years in the City with two of the leading real estate teams.  Her experience spans both high value commercial and residential real estate having acted for both landlords and tenants in a wide range of contentious issues.  Charlotte regularly advises on leasehold enfranchisement and mixed use issues. Charlotte is a member of the Property Litigation Association.

James has experience of dealing with a wide variety of landlord and tenant issues, as well as providing advice upon the nature and extent of property rights.  James holds rights of audience in the Higher Courts of England and Wales and continues to develop his advocacy skills by regularly representing clients in the County Court.  James is a specialist in the Right to Manage.
