The more you see and hear the more you think the English legal system is less about common sense and more about absurdity. Well recently we have received our own share of dealings with the justice system both County Court and LVT. Now where we are different (and probably rightly so from my experience to date) is that I will handle matters and not engage lawyers, unless it gets to a position of technicalities.
Let me explain. I have a personal County Court claim against a kitchen fitter where their sole defence appears to be that I don’t have the right to claim! I thought the judge would see through this charade and smoke screen however, I have had to bring in a barrister because of the obfuscation of the other side’s lawyer.
We made a County Court claim against the owners of a flat in a block we are managing for arrears of service charge, this got moved to LVT (unsurprisingly!) and we found a strange situation where the two defendants do not get on. The barrister for one exclaimed he had sympathy for our position! Anyway the case goes on, we have submitted 10 lever arch files of information 10 times over and still one of the defendants tries to get the case deferred, for lack of information. This matter I am handling and we have processed so far at a fraction of the cost of some LVT cases I have seen of similar complexity where lawyers have been instructed.
There is a final matter ongoing that I cannot detail (but will do so in due course) where I am a defendant and have handled matters myself. The judge has ordered a pre hearing to confirm striking out as there is no arguable claim! I didn’t need a lawyer to tell me that!
So sometimes it is worth standing back and thinking what is in the best interests of the block and do we need to spend their money on lawyers?
