QUESTION
I and 15 other leaseholders in a block of flats have been taken through the major works consultation this year. The tenders were sent through to us and the surveyor who oversaw the consultation paid.
However, we are having a problem with the managing agents issuing invoices for the major works, they haven't done anything. And now there is a risk that the major works may not be completed this year and I assume that would mean they need respecifying by a surveyor then.
We all want the major works to go ahead, how can we get the managing agent to make good on this?
RESPONSE
On the assumption that you and your co-leaseholders are content that the consultation requirements have been met, I would suggest that you seek to engage with the Property Manager of the development to ascertain when the demands for the major works are scheduled to be made.
Dependent upon how the service charge accounting year operates in your lease, it may well be that the major works demand will be made when you are due to make payment of your usual service charge.
I anticipate that given that you and your co-leaseholders appear ready and willing to make payment, your Property Manager will be very receptive to you being pro-active in wishing the works to go ahead as soon as possible.
